Terms of Service

These Terms govern your use of the Repium app ("App") provided by GainsLab ("we," "us"), a registered business name operated by Kousherian Development Inc., an Ontario corporation. By downloading or using the App, you agree to these Terms. If you don't agree, don't use the App.

1. The service

Repium is a workout-tracking app that lets you log exercises, track progress and personal records, and build workout templates. Some features require creating an optional account for cloud backup and syncing.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your region) to use the App.

3. Accounts

An account is optional; you may use the App as a guest.
If you create one, you're responsible for keeping your login credentials secure and for activity under your account.
You may delete your account at any time within the App.

4. Your data and content

Your workout data is yours. You grant us a limited license to store, process, and sync it solely to operate the App for you.
You're responsible for the accuracy of the data you enter and for maintaining your own backups where important to you.

5. Acceptable use

You agree not to: misuse or disrupt the App; attempt to reverse-engineer, decompile, or extract source code except as permitted by law; access the App through unauthorized means; or use it for any unlawful purpose.

6. Intellectual property

The App, its design, branding, and "Repium" name are owned by us and protected by law. The App uses licensed exercise content from ExerciseDB, which remains the property of its owner. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Health & fitness disclaimer

Repium is a tracking tool, not medical, health, or fitness advice. The App does not provide medical guidance, and exercise information is for general reference only. Consult a qualified physician before beginning any exercise program. You use the App and perform any exercises at your own risk, and you assume full responsibility for any injury, harm, or loss. We are not liable for injuries or health outcomes resulting from your use of the App. To the fullest extent permitted by law, you release GainsLab and Kousherian Development Inc. from any claims for injury, harm, or loss arising from exercises you choose to perform.

8. Third-party services

The App relies on third-party services (Apple and Google Firebase). We are not responsible for those services' availability, content, or practices, which are governed by their own terms.

9. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, availability, or that it will be error-free or uninterrupted.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or loss of data, arising from your use of the App. Our total liability for any claim will not exceed the amount you paid us for the App in the 12 months before the claim (or CAD $0 if you use the App for free). Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be waived under applicable law, including EU and UK consumer-protection law.

11. Indemnification

You agree to indemnify and hold harmless GainsLab and Kousherian Development Inc., and their officers and directors, from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Termination

We may suspend or terminate the App or your access if you violate these Terms. You may stop using the App at any time and delete your account.

13. Changes to these Terms

We may update these Terms; continued use after changes means you accept them. The "Last updated" date reflects the current version.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
